Law is the set of rules enforced by a sovereign authority that regulates human conduct. It may be created or reinforced by social or governmental institutions and enforced by a variety of techniques. A legal system may be based on a constitution or on a judicial body with power to interpret the law and decide cases. It may also be based on tradition and custom or a combination of both.
Law has many functions but one of the most important is to protect individuals from harm. This includes protecting them in their property, their reputations, and their personal freedoms. The law also sets out the values that society wishes to encourage in its members. This can include respect for the rights of others, fair treatment and a healthy sense of morality. It can be a guide for the behaviour that is appropriate in different situations and provides people with a standard against which they can compare their actions.
A further function of law is to delineate the limits of a state’s powers and the boundaries of its jurisdiction. The framers of the United States Constitution recognised this issue and sought to ensure that the central government did not have complete power over its citizens by dividing power among several branches including the legislative, executive and judicial systems. This is known as the separation of powers and is an essential feature of our constitutional republic.
However, even a government that is based on the rule of law can be dangerous. Inevitably there will be some people who wish to challenge the laws that govern them. The aspirations of those who wish to achieve greater rights for all citizens are reflected in the many revolts that occur against established political-legal authority. These are often driven by an aspiration for a democratic form of government.
The law can also be seen as a mediator of relations between groups or between individual citizens. The law can determine how much compensation is to be paid in the event of injury or death and how disputes between private individuals will be resolved. Law can also provide a framework for determining how much freedom or privacy a citizen is entitled to and how public goods will be shared between citizens.
A further function of the law is to ensure that justice is dispensable fairly and efficiently. This requires an accurate record of the laws and their application. In addition, it is necessary to ensure that the law reflects society’s changing condition. This can only be achieved if there is a degree of flexibility in the law.
